Growing cities means growing noise. This is especially true in mixed-use urban environments that often contain commercial premises (entertainment, retail, office, hospitality or light manufacturing) sited close to residential uses such as apartments.

The need for local authorities to adopt sound land use planning is a growing practice.

Noise can be thought of as unwanted sound and can vary greatly in volume. Noise can cause annoyance, speech interference, affect performance and concentration, mental health and disturb sleep.

Difficulties often arise where noise-sensitive land uses (such as residential activities) move into or close to established commercial areas or major infrastructural assets such as ports or airports. This is often referred to as ‘reverse sensitivity’ for an explanation of reverse sensitivity and relevant case law).

One technique for dealing with the issue of reverse sensitivity is to ensure people are fully informed of the environment which they are proposing to move into.

Another consideration of factors planners are observing for mixed-use areas include:

* Time of day: There is less tolerance of noise by residents when it occurs at night. Therefore district plan noise limits are typically lower for night.

* Level of sound: Sound levels can range from loud (exceeding the normally occurring or existing background sound level by 10 dBA or more) through to relatively low level with bass or beat components. District plan provisions should allow for some noise to be emitted, but only up to allowable limits measured at the residential location (often around 45-55 dBA).

* Type of sound: Some sounds have a special audible character that can cause additional annoyance.

* Location of premises: Commercial and industrial areas located close to residential sites will often have more noise issues than those occupying sites well within commercial or industrial zones (further from residential sites). District plan noise provisions usually allow higher levels of noise (day and night) within commercial and industrial zones. Distance, and the placement of barriers between the source of the noise and those receiving, are mitigating factors but the ability to use these can be limited in mixed-use environments. Where residential activities locate in established commercial or industrial areas it is more practical for the new residential use to insulate itself from noise than it is for existing commercial uses to comply with acceptable residential noise levels.

* Body corporate and private undertakings: Complaints can arise where noise-sensitive residences are located in the same premises as a noise-making commercial activity. Clauses within leases or body corporate constraints covering noise nuisance often place such complaints beyond the scope of territorial authority action. However, many territorial authorities successfully deal with these matters in the same way as if the parties were located within separate buildings.

Managing noise in the city usually starts at its source. For new noise generating activities, control can be achieved by incorporating appropriate buffer distances. However, as buffer distances are often not practical in inner-city areas where differing land uses tend to be located in close proximity, measures such as the use of noise barriers or insulation may present a more realistic management method.

Barriers may include such features as:

* solid walls or fences to stop or deflect sound

* bunds

* other non-noise sensitive structures

* topography (locating activities in depressions or behind hills for example).

Barriers to control noise emission or to reduce noise received can be effective, but the effects of reflected sound need to be considered within the design and orientation of barriers. Factors such as orientation and materials used in the construction of barriers should be considered. Acoustic consultants can provide detailed guidance to match the specifics of individual sites.

Vegetation is not considered a good sound barrier as it will not block noise emissions unless plantations are very dense. Within inner-city mixed-use environments there are few opportunities to provide planting capable of mitigating noise.

Noise control is most effectively achieved on smaller sites by paying particular attention to design before constructing any buildings. The layout of premises…the location and orientation of openings, loading bays, doors, windows, and car parks…and on-site vehicle circulation patterns are all important for good noise control.

The use of noise management plans may be incorporated into a district plan through permitted activity standards associated with particular (usually known) land uses, or their formulation and compliance with them made a condition on a resource consent. Some district plans actually specify that a noise guidance plan must be prepared to comply with rules.

Other considerations within such districts include:

* Providing indoor living spaces in mixed-use areas with a reasonable standard of acoustic protection is emerging as an effective method of addressing reverse sensitivity.

* Specifying the standard required for acoustic insulation (for example the materials to be used, or the level of sound reduction to be achieved).

As the world’s population grows and cities become denser, the necessity of noise ordinances and the consideration of soundproofing residential areas is becoming a must.

Test Yourself - Is This A Good Deal?

Let’s take a look at a typical deal that came into one of my students. This is not as great as a wholesale or rehab but it could be a good rental. The after repaired value of the property is $105,000. The seller owes $69,000 and they are paying $650 a month for principal, interest, taxes, and insurance, piti. The seller is asking $89,000. In other words, they want to be able to walk away with $20,000. This particular house needs $15,000 of rehab.

Let’s analyze this to see whether or not this is a good deal. The student who sent me this deal actually had cash available and had enough cash in there that they wanted to put the cash to work. The rehab didn’t scare them. Now the seller is asking $89,000. Remember they wanted to walk away with $20,000 over what they owed. I don’t really care what the seller is asking for it. It doesn’t matter. When you buy your own personal house you do care what the seller is asking and you try to negotiate them off of their asking price. In this case when you are dealing as an investor it doesn’t really matter what the seller is asking. All that matters is what you can do with the property. What can you do to make a profit out of it? You have to buy it at a price that makes sense. If you can’t buy it at that price then it is not a deal and you walk away. At what price can you make a profit? What is important in this deal is that they owe $69,000.

Now as a resale there is just no money. Assume you could get the house for $69,000, and your buy, sell and hold costs are $16,000 (15% of the after repaired value). And then we have to add in the rehab of $15,000. If you subtract all that from the value of $105,000 that only leaves $5,000 left. You certainly couldn’t wholesale this property because there would not be enough in there for you and your investor buyer. The only thing you could do is try to renovate this property and try to resell it. And you know it just isn’t worth making a $15,000 investment to make a $5,000 profit. It just wouldn’t make sense. In fact, if you do a deal I always say that you need to make at least $10,000 in it. Let’s look at it again from a rental standpoint. Suppose you could buy this house ‘subject to’ the existing mortgage. This particular seller is behind in their payments and wanting to get out. Perhaps you don’t have to do as much rehab because the $15,000 was based on the fact that you were trying to resell it. With a rental a lot of times you don’t have to do the same level of renovations. Considering rent in the area is $950 a month and remember the current piti on the mortgage is $650 a month. Which means that gives you a $300 a month positive cash flow. Let’s leave 8% in there for vacancy and 6% in there for repair, and you still have $167 net positive cash flow a month. You’ve also built in there $36,000 in equity. You see it didn’t work as a wholesale. It didn’t work as a renovation. It did work as a rental property assuming you had the $15,000 needed to do the rehab. Or maybe even doing a little bit less rehab but still had the cash.

When you consider which area to retire to from the UK or USA you would first think about visa's and permits to live in a certain country, we got around this so far by living our dream before retirement. We live 6 months in the UK and 6 months in Australia as holiday makers. My professional job keeps me busy for 6 months but my salary allows me the ability to travel the rest of the year, we had researched so many places to live, Egypt to Eastern Europe to Florida in the USA.

We chose the Barossa Valley for a few reasons 1 we fell in love with the feel of the place, old buildings yet modern amenities and nice people with that laid back country feel. The place does have class however with good quality eateries to attract the tourists however retaining the local country/vineyard feel. The Barossa Valley is traditional and is backed by many of its German roots, yes the Germans were here very early in the 1800's and settled and have given the place a real German flavour.

Shopping is modern and close by and so are medical facilities. Many people have left the closest city Adelaide to reside in The Barossa Valley. It has become very popular with aussie's as they see it as a little different that the rest of Australia a small Europe.

We pay the neighbour a tiny sum to keep an eye on the house whilst we are in the UK 6 months a year. When it comes to buying Barossa real estate we think it is great value from an international viewpoint. Lovely character homes start at about $450,000 AUD and you can get basic homes as cheap as $200,000 AUD if you happy with a plain jane house.

My wife like's Tanunda for real estate as she see's it increasing in value over time faster than other areas of the region. My wife and I also like the easy walk to the shops and restaurants again, we like the local meats bread and produce its all very good quality and unlike the UK it actually goes rotten in time, what do I mean by this, well in my opinion your buying real food not genetically modified crops.

So overall I love Barossa Valley as my favourite little place to live and relax if I could get a visa to stay for good which one day might happen then I will move there on a permanent basis. The Barossa Valley was a great place to visit Malcolm, Sarah and I went last year and thought we would write an article for the internet to help promote is wonderful region.

I first heard about the Barossa through a friend in the USA saying that it had more feel to it than the California vineyards so thought we should take a visit. I also wanted to visit Sydney and Adelaide as I had heard good things about both. When we arrived in Adelaide we rented a car as this was most practical, I would encourage you to book ahead as a lot of people now know about The Barossa Valley and car are often all booked out.

We found the drive from Adelaide airport to The Barossa Valley quite easy and had made a booking in Greenock at The Old Telegraph Station see www.oldtelegraphstation.com

Malcolm and Sarah commented on the way that they were concerned that the Barossa may just be dry and parched as South Australia have been experiencing a drought. The good news is when we arrived at Greenock the township the local's call Scottish as a lot of people from Scotland settled there, the whole area was lush and green as there were so many vineyards.

As soon as we arrived we fell in love with the cottage and old telegraph station built in 1860 so this immediately gave the trip more historic meaning by staying in an historic property, it was small but very cosy and with an open fire and dreams were fulfilled. I also enjoyed the large indoor spa bath similar to what we have in the U.S.

Malcolm went to the local pub that night to meet some locals and have a quick beer. He ended up coming back 3 hours later after having lots of conversations with the locals. Back at the bed and breakfast Sarah and I planned our next days stay, we decided to do the right thing and check out the cellar doors first then have lunch at Vintners in the Barossa Valley.

After a quick night cap I was off to bed looking forward to a big day touring the Barossa. Malcolm had to check his emails and we were impressed the place had fast speed internet. With this popularity comes a growing internet availability of garage kits. You can find companies across the internet offering various types and styles of garage kits. You can find steel building kits, carport kits, garage kits, and even home kits. But with the ease and availability of these buildings, there are some important facts that you should understand before making your purchase. One such item is what you will need in regard to required plans for permitting.

As with traditional wood structures, you will need to get building permits from your local permitting agency (most likely - depending upon the size and type of your structure). Here is where you need to have done your homework. Before ordering your building kit, speak with your local permitting agency to find out what types of plans you will need. Typically, you will need three sets of plans. You will need engineered building plans (with structural calculations), concrete / foundation plans and a site plan.

When making a building kit purchase, companies often require you to put down a deposit (but you shouldn't, and I'll touch on that later in this article). Your deposit will typically include engineered plans for your building (If obtaining a permit, engineered plans with all structural calculations are usually required for permitting purposes). Buyers are often surprised to find that the included engineered building plans do not include concrete / foundation plan or the site plan. Of course, this means the included structural calculations are pretty much irrelevant and unusable since the concrete / foundation plan is required in order to properly compute the structural calculations!

This also means a building kit buyer will have to find a local engineer to prepare the concrete / foundation plan for them. This can cost an additional $500-$2000 in addition to the original building cost. Let's add this cost to the cost of obtaining correct structural calculations after the fact.

You will also probably need a site plan. Speak with your permitting agency to determine exactly what they require. The specifications will probably differ between a project classified as commercial or as residential. If you project is classified as commercial, there will probably be more requirements needed from you than there would be if the project is classified as residential.

In summary, before you purchase a steel building kit I recommend you take the following steps:

1.Before making your purchase, speak with your local permitting agency to find out what types of plans you will need.

2.As you shop building kits vendors, you will find some reputable companies that will include the concrete / foundation plan with the building kit price. Make sure to specifically ask them about this!

3.When you find a supplier that will supply both the engineered building plans AND the concrete / foundation plans, be prepared to supply some basic information (gathered from your permitting agency). This information will be items like required footer depth, depth of frost line, etc.

4.Some permitting agencies will allow hand-drawn site plans. Find out the specific local requirements. Site plans will have to be obtained locally.

5.Some building kit suppliers will ask you to make a deposit on your building so that they can supply your plans and you get a permit. DON'T do this, unless you are very comfortable with whomever you're dealing with. A reputable supplier will not ask for a deposit, but will only ask you to buy the plans first (about $500 to $700). The problem with putting a deposit down is that there are too many variables that can happen that can make the building project fall through. If this happens, then you can be out a sizable amount of money.

Feel free to make low offers on those homes that have been on the market for a month or so. Those that have been on the market for a year are owned by people who are willing to wait out the storm and will most likely not be sold for a low price.

Why Is The Owner Selling?

You can find this out by directly asking or looking around. If the home is in a state of disrepair, chances are that there are financial problems. You can offer a significant amount less. If the owner has another home that they are buying, you can also offer less.

Make sure you do your homework and do not be afraid to invest during a real estate recession. Contrary to what you may have heard, this is the best time to buy a home.

On July 17, 1947, The National Association of Real Estate Boards applied to the United States Patent Office to register REALTOR as a trademark. The date claimed for first usage was March 31, 1916. It first came into common parlance with an utterance by a witness at a subcommittee hearing in 1919. Three years later, Sinclair Lewis used it in his novel, "Babbitt". The word appeared in dictionaries in 1917.

Today, most dictionaries define the word as having to do with the National Association of REALTORS®. However, this doesn't stop language from flowing around the boundaries of law. Many people use the word "realtor" interchangeably with "real estate agent". In speech, it may be overlooked, but since the NAR does not want the people who are not authorized by the Board to be mixed up with their own members, they are less forgiving of the improper usage of "realtor" in print, even by REALTORS® themselves.

First of all, if you're not a REALTOR® and you pass yourself off as one, with the usage of REALTOR or REALTORS in your site or your advertising, NAR is gonna get medieval on yo' assets. It usually starts with a cease-and-desist letter, but gets worse from there. They aren't out to get you; they view you as a possible future REALTOR®! However, they do have the power, as the holders of the trademark, to successfully initiate legal action against those who use the word outside of their rules, even as a domain name. So, play nice.

Domain names are tricky, even for a REALTOR® in good standing. For instance, you are perfectly free to register HepzibahSnigglesworthRealtor.com, if Hepzibah Snigglesworth is really your name, but don't waste your money on ImaRealtorwhocanmakeallyourdreamscometrue.com. Likewise, if you try to register CrappoRealtor.com and you are not a resident of Crappo, MD, the NAR will not look upon you with a friendly eye. If you are a resident of Fairdealing, MO, though, you may be able to snag FairDealingRealtor.com. You may register TheBestEverRealtor.com if The Best Ever is the name of your company.

Using variations on REALTOR® is also frowned upon. Creative misspellings, terms that indicate that you are anything but a REALTOR®, even reproduction for novelty items like T-shirts can constitute infringement. You will have problems if you want to title your Great American Realtor Novel, "Realtors of Crappo". It's always best to contact the NAR when in doubt and get their advice.

One place where you might see some variations on NAR's protection of its trademarks is the news. Since journalists have their own standards to adhere to, it's possible that REALTOR® will be used without the identifying trademark symbol. Newspapers do this because trademarks break up the flow of articles and make them hard to read. However, NAR is on the lookout for articles that use realtor interchangeably with "real estate agent" or as a label for anything other than what NAR has designated it for.

When in doubt, use a synonym, euphemism, simile, metaphor or contact the NAR. The NAR isn't out to get you, but it will defend its right to set standards for its trademarks. The misuse of term REALTOR® is something that the NAR takes seriously, but with a little research, it's easy to find out what is acceptable use.

5. The Haunting (1963)

This is the 1963 version and not the unwieldy 1999 remake. Might keep this one in mind if you decide to check out a house with a dark past. A team of paranormal investigators find that an old mansion contains more sinister forces than mold and termites and loss of equity.

6. The Tenant (1976)

Roman Polanski plays a man who becomes afraid that his landlord and neighbors are trying to mold him into the previous tenant so that he will commit suicide too. This film isn't a sparkling example of landlord-tenant relations, but it does bring in a good creep factor to rental property investments.

7. The Uninvited (1944)

It's another case of a well-appointed house being purchased at a suspiciously low price. Of course, the new owner finds that there are some supernatural squatters who make life... difficult. As in, make it difficult to stay alive. As with many other older films, watch this one instead of its remakes.

Traumatizing shower lovers for nearly 50 years, Psycho features the brooding Bates' house that overlooks the Bates Motel. It would be a better investment if its owner wasn't channeling his murderous mother, but you can't expect everything. The real house is still available for viewing via tourbus at the Los Angeles Universal Studios.

9. Arachnaphobia (1990)

A doctor moves his family away from the big, bad city to end up fighting big, bad spiders. It's what you get when you find a cheap house in a safe neighborhood: something always comes along to threaten your life. Classic tale for those who are unconvinced of the need for a pest inspection before buying - big South American killer spiders could get YOU.

10. Hot Fuzz (2007)

Not a horror movie per se, but still an exceptionally violent film illustrating that sleepy, well-to-do, neighborly towns with picturesque heritage houses ALWAYS have something wrong with them, like secret cults murdering wayward villagers. A terrific action flick that takes on the buddy cop genre and adds a swan or two.

When evaluating your buyers for a loan, it can be tempting to assume they'll be able to meet the obligations. However, you should always be sure to follow appropriate procedures and make sure. Here are some of the benefits of seller financing, and how to go about it.

Seller financing has a lot of advantages. For instance, seller financing can be a great tool in bringing buyers and sellers together to make sure the real estate deal gets closed. Both parties can benefit if the right circumstances occur. While you might associate seller financing with shady real estate organizations, the fact is that it's great for the right buyer and the right seller.

Seller financing has often been used to help bridge the gap for homebuyers between the down payment and the available amount of their first mortgage. It's also been used to create new financing to wrap around an existing plan. However, it can also be used in the first lien position. For large parcels of bare land that a conventional lender might not traditionally finance, this can be a big help.

Both buyer and seller will see a significant savings when it comes to their closing costs if they decide to use seller financing. They can negotiate interest rates, repayment schedules and other loan conditions as they see fit. It's also easy for special conditions to be included in this type of arrangement. If household appliances, vehicles, or other unusual items are to be included in the real estate sale, seller financing allows them to be specified. Borrowers also do not need to qualify with a standard loan underwriter, and there are no PMI insurance premiums unless you choose to negotiate them.

Sellers benefit by possibly getting a higher yield on their real estate investment, since they'll receive interest. Higher selling prices may be available for helping your buyer with financing, or you can sell a troublesome property "as is". That means that costly repairs that might be required by a conventional lender could be avoided. Sellers are able to screen buyers for their trustworthiness on a case-by-case basis, and may choose what insurance will be required. The seller is also able to decide what kind of security document (a land sales document, deed of trust, mortgage, etc) is best for securing their interests until the loan has been paid.

Of course, when you're getting into a seller financing arrangement, you have to be the bank. That means going through all the procedures that a conventional lender would, in order to determine whether your buyer is a safe risk. However, by offering to be the bank, you increase the number of possible potential buyers for your real estate, thus making it more likely that you'll get a sale.

When you offer seller financing, it'll be necessary to run a credit check, just like a bank would in any real estate deal. This tells you how likely your potential buyer is to pay back the loan. You can charge an application fee to cover the cost of getting the report, just like a bank. You can either subscribe to a credit reporting service, like a conventional lender, or pay a mortgage broker to pull the report. The broker may also interpret that report for you.

In addition to your buyer's credit history, you should also check his or her cash reserves. Most banks want applicants for loans to have enough money in their savings to cover two months worth of mortgage payments. When you offer seller financing for real estate, you will want to require adequate cash reserves as well. If your buyer doesn't have good reserves, they may never catch up to their payments if there's a problem. Buyers who are living paycheck to paycheck are at a greater risk of being late.

Pay attention to the buyer's debt to income ratio, too. This will tell you if he or she has enough income to meet the obligation. Find out what the annual income, monthly income, monthly housing allowance and total debt are. This will tell you how much your buyer can afford to pay you per month. Remember to verify all statements of income. W-2s and other tax forms are an effective way to do this.

Once you know what your buyer can pay and how likely he or she is to pay you, maximize your odds of succeeding in your seller financing deal. A higher down payment makes it less likely that a buyer will default. In general, a down payment of ten percent or more decreases this likelihood by as much as seventy five percent. You can also ask your buyer to pledge other assets to secure this loan, a common tactic used by banks on commercial loans. If your buyer feels hesitant about the real estate deal, you may include a partial mortgage release statement. That way, if the loan value goes below a certain amount, the assets will be released.

When offering seller financing for your real estate, be sure to have a plan for foreclosure, too. While you don't want to assume that the loan won't be repaid, having a plan in case it does is a good idea. The best way to avoid being devastated by default is to be prepared for it. Make sure the loan is on public record, and find out the cost of a foreclosure before you even write the mortgage. Stay in touch with your borrower at all times, and let him or her know that there are other options than foreclosure if there are problems. Make sure you have enough money in reserve to foreclose if needed, and to remarket the property.

Last, be firm with your potential buyer. Don't be afraid to stand up for clauses you need to include in your seller financing deal and don't be timid about foreclosure if it's required. You're acting as the bank in a seller financing real estate deal. That means it's important to do what the bank would do if you need to. However, unlike the bank, you're able to offer a more customized deal, allowing a greater advantage when it comes to finding a buyer for your property.
